fal Acceptable Use Policy

fal – Features & Labels, Inc. (“we” or “our”) is a generative media platform for consumers, developers, and businesses (each, a “User”). Our mission is to amplify and expand human creativity. To achieve this, we believe in building a safe, civil and diverse community that inspires and fosters creativity, while preserving individual’s freedoms of expression and respecting each other’s protected rights.

fal provides access to AI models developed by third parties. While these providers may apply their own safeguards, users remain subject to this acceptable use policy (this “AUP”). By using our Services, you agree to comply this AUP, which we may update from time-to-time. Violation of this AUP can result in action against you or your account, including without limitation legal action or suspension or termination of your account. Capitalized terms used but not defined herein shall have the meanings ascribed to them in fal’s Terms of Service.

You acknowledge and agree that you are fully responsible for your and your users’ use of the Services and will only do so in a safe, responsible, and lawful manner in accordance with the rules set forth below.

1. Safety
   Don’t use the Services or use any Inputs or Outputs to promote or engage in, generate, contribute to, or further any illegal, unlawful, or indecent activities or content, including without limitation:

   1. Sexualization, exploitation, or harm to children or minors, including the solicitation, creation, acquisition, or dissemination of child exploitative content such as child sexual abuse material, grooming communications, or sextortion content.
   2. The illegal distribution of information or materials to minors, including obscene materials.
   3. Depicting the likeness of an individual in a sexual or pornographic manner without their consent, known as non-consensual intimate imagery.
   4. Depicting, promoting, or generating human trafficking, exploitation, sexual violence, or any other harmful, violent, or sexually explicit content
   5. Promoting or facilitating harmful behavior, self-injury, or suicide.
   6. Terrorism, violent extremism, or content that recruits for, incites, or provides operational support to terrorist organizations.

2. Civility
   Don’t use the Services to engage in, promote, incite, or facilitate any uncivil activity or content, including without limitation:

   1. Threats, harassment, bullying, abuse, or inciting violence of any individual or groups of individuals.
   2. Discrimination, slurs, or hate speech, or other content that dehumanizes or advocates for the discrimination of individuals or groups based on a legally protected characteristic.
   3. Gratuitously violent content, extreme gore, or content depicting torture, mutilation, or animal abuse.
   4. Profanity that is intended to shock, disturb, or harass.
   5. Inciting violence against an individual, group of individuals, or institution.
   6. Misinformation or disinformation, including content that is intentionally deceptive and likely to adversely affect public health, public safety, election integrity, or civic participation.

3. Integrity
   Don’t use the Services to engage in, promote, incite, or facilitate any fraudulent, deceptive, defaming, scamming, spamming, or otherwise unethical or illegal activity:

   1. Cheating, scams, or other schemes designed to defraud or deceive others.
   2. Fraud, defamation, or other deceptive practices intended to cause harm or obtain an unfair advantage that distort a person’s behavior or decision-making in a manner likely to cause harm or prevent them from making informed decisions.
   3. Identity theft, impersonation, or deepfakes, including using another person's name, image, voice, or other likeness without their consent to impersonate them in any commercial, profane, defamatory, illegal, or otherwise harmful manner.
   4. Spam, including the generation or distribution of unsolicited bulk messages, communications, or content.

4. Dignity
   Don’t use the Services or use any Inputs or Outputs in a way that:

   1. Violates any third party’s privacy, publicity or other legal rights.
   2. Violates any copyright, trademark, or other intellectual property rights.
   3. Discriminates against any individual or group of individuals based on protected classification or otherwise in violation of any applicable laws or regulations.

5. Compliance
   Don’t use the Services in any way or for any purpose:

   1. that breaches fal’s Terms of Service, including without limitation this AUP, or any third party terms related to the use of third party products and services.
   2. In violation of any applicable laws or regulations.

6. Criminality
   Don’t use the Services to engage in, facilitate, further, or generate any criminal activity, such as

   1. The creation of any illegal or regulated goods and activities.
   2. Any other criminal activity.

7. Security
   Don’t use the Services to collect, process, disclose, or otherwise compromise any personal, sensitive, or confidential information, or to engage in any activity that threatens the security or integrity of the Services including:

   1. Collecting, processing, or disclosing personal or sensitive information such as
      1. Personally identifiable information (PII).
      2. Protected health information (PHI).
      3. Sensitive personal information, such as racial or ethnic origin, political opinions, religious beliefs, sexual orientation, or trade union membership.
      4. Financial information (such as credit card numbers, bank account details, or other payment credentials).
      5. An individual's image, voice, or likeness in violation of their rights.
      6. Biometric data (such as facial recognition data, fingerprints, voiceprints, or retinal scans).
   2. Engaging in or facilitating unauthorized access to any system, network, or data, or other malicious or disruptive activity targeting any system, network, or infrastructure.
   3. Creating, generating, or facilitating the creation of malicious code, malware, computer viruses, or doing anything that could disable, overburden, interfere with, or impair the proper working, integrity, operation, or appearance of our website, the Services, or any third-party services included in the Services.
   4. Attempting to reverse-engineer, decompile, extract model weights, or otherwise derive the underlying algorithms, source code, or architecture of any AI models accessible through the Services, or circumventing any safety guardrails, content filters, or other protective measures implemented by fal or its third-party model providers.
   5. Extracting any metadata or reverse-engineering model behavior to infer personal information, identity, or content provenance.

8. Other Restrictions
   You will not use the Services if:

   1. you are under 18 years of age;
   2. you are located in any country, territory, or region that is the target of comprehensive sanctions administered by (i) the U.S. Department of the Treasury's Office of Foreign Assets Control ("OFAC"), the U.S. Department of State, or any other U.S. government authority; (ii) the European Union or any EU Member State; (iii) His Majesty's Treasury or any other authority of the United Kingdom; or (iv) any other governmental authority with jurisdiction over fal or its affiliates (collectively, the authorities in (i) through (iv), "Sanctions Authorities," and the sanctioned countries, territories, and regions, "Restricted Territories"); or
   3. we have previously terminated your account and informed you that you are banned from using the fal services.

9. Managing End User Accounts
   If you are the administrator or manager of a Team Organization, or otherwise administer or manage End User Accounts, you are responsible for ensuring that the End Users whose accounts you manage have accepted fal’s Terms of Service, and for ensuring that the End Users whose accounts you manage comply with this AUP. In addition, you also agree that it is a violation of this AUP and fal’s Terms of Service if you:

   1. Fail to report child sexual abuse material.
   2. Fail to employ, with respect to your End Users, any legally required age-gating and verification.
   3. Fail to cooperate with fal’s efforts to enforce this AUP and fal’s Terms of Service.

Enforcement

Any breach of this policy or misuse of the fal Services may result in suspension or termination of your account. In the event of termination, fal may also block access to a particular IP address or domain. fal may report any violations of applicable law or regulations to the relevant authorities and cooperate with such authorities or any third parties in any investigation, which may include disclosing your content on the fal platform, information related to the breach or misuse, and any other information fal has about you and your account.
